Please read these Terms of Service carefully. By using Finally Send It!, you agree to be bound by these terms.
1. What Finally Send It! Is
Finally Send It! is a “dead man's switch” service. You compose messages — emails and file attachments — in advance, and we hold them securely. You maintain a countdown timer. If you reset the timer before it reaches zero, nothing is sent. If the timer expires and the grace period passes without a reset, your messages are automatically dispatched to the recipients you specified.
This is the entire and only service we provide. It is a tool for personal correspondence — messages to family, friends, attorneys, or executors.
CRITICAL DISCLAIMER — NOT A LIFE-SAFETY SYSTEM
Finally Send It! is not a medical alert system, a personal emergency response system, a falls-detection service, a health-monitoring platform, or any kind of life-safety device. We do not contact emergency services, medical professionals, or first responders. We do not monitor your health, location, or well-being in real time. If you need a system that summons help in an emergency, call 911 or use a dedicated medical-alert service.
You are solely responsible for maintaining access to your account and regularly resetting your timer. No notification or failure of notification relieves you of this responsibility.
2. Eligibility & Accounts
2.1 Age
You must be at least 18 years old to use Finally Send It!. By creating an account, you represent that you are 18 or older.
2.2 Registration & Security
You register with an email address and a password. You may also enroll passkeys (WebAuthn credentials) for password-free access. You are responsible for keeping your login credentials confidential. Because your messages may carry life-or-death significance, we strongly recommend using a passkey and keeping a recovery code in a safe place.
2.3 Account Verification
New accounts must verify their email address before composing messages, adding contacts, or setting the switch timer. Unverified accounts are locked behind a verification wall.
2.4 Accuracy
You must provide accurate, current information and keep it up to date. We are not responsible for undelivered messages caused by an outdated email address or expired billing information.
3. Subscriptions & Billing
3.1 Plans
Finally Send It! offers tiered subscription plans: Basic, Lite, Pro, and Ultimate. Each plan has limits on the number of scheduled emails, contacts, and attachment storage. Details are shown on our pricing page.
3.2 Payment
All subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor. We do not see or store your full payment card details — Stripe handles all card data directly. By subscribing, you authorize Stripe to charge your payment method on each billing date.
3.3 Proration & Plan Changes
Upgrading or downgrading your plan takes effect immediately. Charges are prorated so you never lose time you've already paid for. Downgrades may reduce your limits; if you exceed the new plan's limits, you will be asked to trim your data before the change completes.
3.4 Cancellation & Refunds
You may cancel your subscription at any time from your billing settings. Your service continues until the end of the current billing period. We do not offer partial refunds for unused time. After cancellation, your account remains accessible at the Basic tier (or as a limited free account) unless you close it.
4. Your Content
4.1 Ownership
You retain all ownership and intellectual property rights in the messages, attachments, and contact information you store in Finally Send It! (“Your Content”). We claim no ownership over it.
4.2 License to Us
By using the service, you grant us a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the service (holding it securely and dispatching it on timer expiry). We never access Your Content for any other purpose unless required by law.
4.3 Your Responsibility
You are solely responsible for Your Content. You represent that your messages and their dispatch do not violate any law, third-party right, or these terms.
4.4 Recipients
You are responsible for choosing your recipients and ensuring that your messages are appropriate, accurate, and lawful. We do not review, approve, or take responsibility for the content of your messages. If you name someone as an executor or attorney in your correspondence, that designation has no legal force through our platform — consult a real attorney for estate planning.
5. Acceptable Use
You agree not to use Finally Send It! to:
- Send spam, unsolicited bulk communications, or harassment.
- Distribute malware, viruses, or any harmful code.
- Impersonate any person or entity, or misrepresent your identity.
- Store or transmit content that is illegal, defamatory, threatening, or otherwise unlawful.
- Attempt to break, probe, or circumvent our security measures.
Violation of this section may result in immediate suspension or termination of your account without notice.
6. The Switch — How Dispatch Works
6.1 Timer Reset
Every account has exactly one global countdown timer. You can reset it from the dashboard or from the switch page at /switch/<your-token>. The switch page is designed to be PWA-installable so it can live on your phone's home screen. Each reset restarts the timer from your configured interval.
6.2 Grace Period
If the timer reaches zero, a grace period begins. You can configure this from 0 to 24 hours. A reset during the grace period restarts the timer normally. If the grace period expires without a reset, dispatch begins.
6.3 What Gets Sent
When the switch fires, every scheduled email in your account is dispatched to its recipients with all attachments. There is no way to stop dispatch once the grace period has expired.
IMPORTANT — NO GUARANTEE OF DELIVERY
We send messages through third-party email providers (currently Resend). We use industry-standard practices, but we cannot and do not guarantee that every message will be delivered, delivered on time, or delivered at all. Email can be delayed, filtered as spam, rejected by the recipient's server, or lost. Physical delivery of messages depends on factors beyond our control.
If your messages are time-sensitive or carry legal significance, we strongly recommend testing that your recipients can receive them and confirming their email addresses are current.
7. Data Security & Encryption
We take the confidentiality of your messages seriously. Message bodies, subjects, and contact information are encrypted using envelope encryption (AES-256-GCM) before they are stored. Attachments are encrypted with a similar scheme (AES-256-CTR + HMAC). Each item has its own data-encryption key, which is itself wrapped under a master key we manage.
We use industry-standard security practices including encrypted connections (TLS), rate limiting, parameterized database queries, and audit logging of administrative actions. No system is impenetrable, and we cannot guarantee that unauthorized access will never occur.
8. Third-Party Services
Finally Send It! relies on several third-party services to operate:
- Hetzner Cloud — server hosting (Nuremberg, Germany)
- Laravel Forge — server management
- Stripe — payment processing
- Resend — email delivery
- Cloudflare — DNS, DDoS protection, CDN
- Cloudflare R2 — attachment storage and database backups
Each of these services has its own terms and privacy practices. We are not responsible for their operation or any failure of theirs that affects our service.
9. Privacy
Our Privacy Policy explains what personal data we collect, how we use it, and your rights. By using Finally Send It!, you agree to the practices described there.
10. Intellectual Property
The Finally Send It! name, logo, visual design, and software are owned by the service operator. You may not copy, modify, reverse-engineer, or redistribute the service or its components without permission. This section does not affect your ownership of Your Content.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FINALLY SEND IT!, ITS OPERATORS, AND ITS THIRD-PARTY SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
This includes, without limitation:
- Messages not being delivered, being delivered late, or being sent to the wrong recipient.
- Loss of data, including messages, contacts, or attachments.
- Unauthorized access to your account or messages.
- The service being unavailable, slow, or failing for any period.
- Any actions taken or not taken by a recipient of your messages.
Our total liability to you for any claim arising from the service will not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free, or that dispatch will occur at any particular time or at all.
13. Termination
13.1 By You
You may close your account at any time from your profile settings. When you close your account, all your messages, contacts, and attachments are permanently deleted. This cannot be undone.
13.2 By Us
We may suspend or terminate your account immediately if you violate these terms, particularly the Acceptable Use section. We will make reasonable efforts to notify you before termination, but may act immediately if your actions threaten the security or integrity of the service or other users.
13.3 Effect of Termination
Upon termination, your messages will not be dispatched. We have no obligation to forward or export your data after termination. Please export anything important before closing your account.
14. Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. Any disputes arising from these terms or the service will be resolved in the state or federal courts located in Travis County, Texas.
15. Changes to These Terms
We may update these Terms of Service from time to time. If we make material changes, we will notify you by email and/or by placing a notice on the service. Your continued use after the updated terms take effect constitutes your acceptance of the changes. If you do not agree, you must stop using the service and close your account before the new terms take effect.
